Terms & Conditions (Website Terms of Use)

Principal Pools Ltd (“Principal Pools”, “we”, “us”)
Last updated: 3 March 2026

These Terms & Conditions apply to your use of the Principal Pools website (the “Website”). By using this Website, you agree to these Terms.

1) About us

Principal Pools is a New Zealand business providing fibreglass pool information and related services.

Contact: info@principalpools.co.nz | 09 873 3838
Office: Warkworth, Auckland, New Zealand

2) Website use

You agree that you will not:

  • misuse the Website (including attempting to hack, introduce malware, scrape or disrupt services)

  • use the Website for unlawful purposes

  • copy or republish content from the Website except as permitted by law or with our written consent.

3) Intellectual property

Unless stated otherwise, all content on this Website (text, photos, videos, graphics, logos, design, and downloadable resources) is owned by or licensed to Principal Pools and is protected by intellectual property laws. You may view and print pages for personal use, but you must not reproduce or commercialise Website content without permission.

4) Enquiries, bookings and quotes

Submitting an enquiry or requesting a quote through this Website:

  • does not create a binding contract

  • is an invitation for us to contact you and discuss your project

  • may require a site visit or follow-up questions before we can provide accurate pricing or advice.

Any contract for supply/installation of a pool will be set out in a separate written agreement (proposal/quote/contract) and will govern scope, exclusions, timelines, and payment terms.

5) Pricing, “from” pricing, promotions and estimates (important)

We may publish pricing guides, ranges, “from” pricing, promotions, or example packages to help customers plan. However:

  • All pricing on this Website is indicative only and may change at any time.

  • Final pricing depends on project-specific factors including (without limitation): site access, ground conditions, excavation requirements, drainage, services, engineering, council requirements/consents (where applicable), pool fencing/barrier requirements, product selections, and final scope confirmed in writing.

  • A price is only confirmed when we issue a written quote/proposal and it is accepted in writing.

Note: Under the Fair Trading Act, businesses in New Zealand must not mislead consumers about pricing or advertising.
Also, “fine print” does not fix an overall misleading impression—so we aim to present pricing information clearly.

6) Information on this Website (general guidance only)

We try to keep Website information accurate and up to date, but the Website provides general information only and may not reflect your specific property or requirements. You should not rely solely on Website information for decisions about construction, compliance, safety, or legal obligations.

7) Compliance, consents and pool safety (general guidance)

Installing an inground pool can involve legal and safety obligations (including pool barriers/fencing and council processes).

  • Residential pools that can hold 400mm or more of water generally require compliant barriers to restrict access by unsupervised children, and fencing/barriers may require council involvement.

  • Unless we explicitly agree otherwise in writing, you are responsible for confirming your site-specific requirements with your local council and ensuring compliance (including fencing/barriers and inspections where applicable).

8) Project timelines

Any timeframes referenced on the Website (or discussed prior to a written agreement) are estimates only and may be affected by factors outside our control such as weather, supplier lead times, access, unforeseen ground conditions, council processing, and customer variations.

9) Variations and unforeseen conditions

Construction projects can change once work begins. Unforeseen site conditions (e.g., rock, groundwater, limited access, drainage requirements, hidden services) may require changes to scope or additional costs. Where applicable, these will be discussed and documented in writing.

10) Marketing communications (email/SMS)

If you submit an enquiry, request information, or become a customer, we may contact you by phone, email, or SMS about your enquiry and related services.

Where we send marketing messages by email/SMS, we will do so in accordance with New Zealand anti-spam rules, including identifying the sender and providing an unsubscribe option.

11) Privacy, cookies and tracking

Your use of this Website (including forms, cookies, analytics and advertising/remarketing tags) is handled under our Privacy Policy. Our Privacy Policy explains what we collect, why, and who we may share it with, consistent with NZ privacy requirements around transparency.

12) Third-party links

This Website may link to third-party websites or services (including social media platforms). We are not responsible for the content, security, or privacy practices of third parties. Access them at your own risk.

13) Disclaimer

To the maximum extent permitted by law, we provide the Website “as is” and “as available”. We do not warrant that the Website will be uninterrupted, error-free, or free of harmful components.

14) Limitation of liability

To the maximum extent permitted by law, Principal Pools will not be liable for any indirect or consequential loss, loss of profit, loss of opportunity, or loss of data arising from your use of (or inability to use) this Website or reliance on its content.

Where liability cannot be excluded under law, our liability is limited to the minimum extent permitted.

15) Consumer rights

Nothing in these Terms is intended to limit or exclude rights you may have under New Zealand consumer law, including the Consumer Guarantees Act 1993 (where it applies).

If our services involve residential building work, statutory protections (including implied warranties) may apply regardless of contract wording.

16) Changes to these Terms

We may update these Terms from time to time by posting the updated version on this page. Your continued use of the Website means you accept the updated Terms.

17) Governing law

These Terms are governed by the laws of New Zealand, and New Zealand courts have non-exclusive jurisdiction.
